3. Definitions

In these Terms:

"Candidate" means a person seeking employment, considering employment opportunities or submitting professional information to Hampshire Barnes Ltd.

"Client" means an employer, prospective employer or organisation using or considering using our recruitment services.

"Hampshire Barnes", "we", "us" or "our" means Hampshire Barnes Ltd.

5.5 Recruitment services supplied to employers are subject to Hampshire Barnes Ltd's separate Employer Terms of Business.

5.6 Where there is a conflict between these Website Terms and agreed Employer Terms of Business, the Employer Terms of Business will take priority in relation to recruitment and Candidate introduction services.

6. Candidate responsibilities

6.1 Candidates must ensure that all information provided to us is accurate, complete and current.

6.2 Candidates must promptly notify us of material changes to their:

  1. employment status;
  2. availability;
  3. notice period;
  4. qualifications;
  5. professional registrations;
  6. contact details;
  7. salary expectations;
  8. location or mobility;
  9. preferred working arrangements; and
  10. right-to-work status.

6.3 Candidates must not knowingly provide false or misleading information about:

  1. their identity;
  2. employment history;
  3. qualifications;
  4. skills or experience;
  5. professional registrations;
  6. right to work;
  7. current remuneration; or
  8. suitability for a role.

6.4 Candidates are responsible for reviewing the details of any vacancy before agreeing to be represented or submitted.

6.5 We will normally seek a Candidate's permission before providing identifiable Candidate information to a prospective employer.

6.6 Candidates must tell us if:

  1. they have already applied directly to an employer;
  2. another recruitment agency has submitted them to the same employer or vacancy;
  3. they are already in recruitment discussions with the employer; or
  4. there may be any conflict concerning representation.

6.7 Hampshire Barnes Ltd does not charge Candidates a fee for introducing them to an employer for permanent employment.

6.8 Candidates remain responsible for deciding whether to accept an interview, offer or employment opportunity.

7. Employer responsibilities

7.1 Employers using the Website must provide accurate and complete information concerning:

  1. the employer's identity;
  2. the vacancy;
  3. duties and responsibilities;
  4. location and working arrangements;
  5. remuneration and benefits;
  6. required qualifications and experience;
  7. health and safety risks;
  8. anticipated start date;

  10. the employer's authority to recruit.

7.2 Employers are responsible for:

  1. deciding whether a Candidate is suitable;
  2. conducting interviews and assessments;
  3. checking qualifications, licences and registrations;
  4. obtaining references;
  5. verifying identity and right to work;
  6. completing lawful background, criminal-record or security checks where required;
  7. complying with equality and employment law;
  8. providing a safe working environment; and
  9. issuing lawful employment documentation.

7.3 Employers must not use Candidate information for any purpose other than legitimate recruitment.

7.4 Employers must not disclose Candidate information to third parties without lawful authority.

7.5 An employer's receipt, interview or Engagement of a Candidate introduced by Hampshire Barnes Ltd may give rise to obligations under the Employer Terms of Business.

8. Vacancy listings

8.1 We take reasonable care when publishing vacancy information.

8.2 Vacancies may be:

  1. amended;
  2. suspended;
  3. withdrawn;
  4. placed on hold; or
  5. filled without notice.

8.3 Unless expressly confirmed otherwise, details concerning:

  1. salary;
  2. benefits;
  3. location;
  4. working arrangements;
  5. duties;
  6. reporting lines; and
  7. start dates,

are indicative and subject to confirmation by the employer.
